COVID-19 Waiver
The World Health Organization (WHO) has declared the novel coronavirus, COVID-19, a worldwide pandemic. COVID-19 is extremely contagious. The WHO says most people infected with the COVID-19 virus will experience mild to moderate respiratory illness and recover without requiring special treatment. Older people, and those with underlying medical problems like cardiovascular disease, diabetes, chronic respiratory disease, and cancer are more likely to develop serious illness. According to the WHO, the COVID-19 virus spreads primarily through droplets of saliva or discharge from the nose when an infected person coughs or sneezes. COVID-19 is shown to cause serious illness and death.
YPO, Inc. (“YPO”) cannot prevent you or your spouse, children, or guests from becoming exposed to, contracting, or spreading COVID-19 while on YPO’s premises, at a YPO event or activity, or performing any action for or on behalf of YPO or with representatives of YPO. Any in-person interaction with, at, or for YPO and its representatives may increase your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risks associated with COVID-19 for myself and, to the extent applicable, for my spouse, children, and guests, in order to utilize YPO’s services or premises, including attending a YPO event. These services are of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize YPO’s services or premises in person rather than arranging for an alternative method of enjoying the same services virtually (e.g. videoconference) or not enjoying the services at all.
RELEASE AND WAIVER OF LIABILITY: I hereby forever release and waive all claims and rights against YPO, its regions, chapters, members, officers, directors, employees, contractors, agents, and representatives (the “YPO Releasees”) in connection with exposure, infection, and/or spread of COVID-19 related to utilizing YPO’s services or premises, including attending a YPO event. I understand that this release and waiver means I give up my right to bring any claims related to COVID-19, including for personal injuries, death, disease, property losses, or any other loss that may be released and waived under applicable law, including claims of negligence on the part of the YPO Releasees, and I understand that this release and waiver prevents me from seeking damages in any way against the YPO Releasees, whether such damages are known or unknown, foreseen or unforeseen, or that occur now or in the future. I specifically give up my right to initiate suit against YPO for any matter contemplated by this release and waiver. I also intend this release to apply, to the extent permitted under applicable law, to any claims my spouse, children, or guests could assert related to the subject matter of this release and waiver.
CHOICE OF LAW: I understand and agree that the law of the State of Texas, U.S.A. will apply to this contract. If anything in this contract is held unenforceable, I agree that such limited parts shall be severed and the remaining provisions shall remain in full force and effect.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE AND WAIVER, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
